Churchill juror slams judge’s ruling on reinstatement

From the Boulder Daily Camera:

Bethany Newill, in an affidavit accompanying a motion Churchill filed with the court late Tuesday asking the judge to amend his ruling earlier this month, wrote that her time on the jury was “wasted” as the result of Chief Denver District Judge Larry Naves’ July 7 decision to vacate the verdict.

Updates coming.

Update: I also noticed this in the comments to the above Daily Camera article, posted by one John Q Public.

I’ve heard that pulling cases away from juries is pretty common for Judge Naves. He seems to prefer deciding the facts himself over allowing a jury’s decision to stand. Apparently, he did it again last week in another, separate case, basically removing the jury, making a decision, and forcing a settlement.

Interesting.

Update II: You can read Bethany Newill’s complete affadavit here. You can also read Ward Churchill complete motion to amend Naves’ ruling here.

Update III: You can read a comparison between Judge Naves’ ruling and CU’s pleadings here.

Naves should be removed from the bench. The CU Regents operate as a legal body like our district courts do. Right? Ward can’t sue CU because they act in a similiar fashion to our courts. What a crock! This ruling was ludicrous. But it doesn’t stop here. Naves should have instructed the jury to return to deliberation in order to come up with a settlement figure. He should never have allowed the jury to find CU guilty but only award him a dollar. He obviously has a bias against Ward. I can only hope Ward wins on appeal. I’m a CU alumni and they won’t get another dime from me ever again.

Yeah, I’m a CU grad as well, and I take a special satisfaction in telling their telemarketers to go to hell.

What they’re dragging her through almost gives you an incentive to refuse to serve on a jury. It wasn’t like she volunteered and competed to be there.

You can’t expect justice from the kangaroo kourts of Amerikkka. There are no rights, only power struggles.
